These Terms of Service ("Terms") govern your access to and use of CFX’s services, including our website (www.cfxevents.com), products, and related offerings (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use our Services.
1. Definitions
1.1 "Company" refers to CFX, its affiliates, employees, and authorized representatives.
1.2 "Client" refers to any individual, company, or entity that uses CFX’s Services.
2. Services Provided
2.1 CFX provides event planning, management, marketing, creative strategy, and other related services.
2.2 Service specifics, timelines, and deliverables will be outlined in a separate agreement or proposal for each project.
2.3 CFX reserves the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.
3. Client Responsibilities
3.1 Clients must provide accurate and complete information necessary for the fulfillment of the Services.
3.2 Clients must ensure timely approvals, feedback, and payments to avoid delays.
3.3 Clients agree not to use the Services for unlawful purposes or in ways that violate these Terms.
4. Payment Terms
4.1 Payment schedules, fees, and methods will be specified in the service agreement or invoice.
4.2 Late payments may be subject to a fee.
4.3 Non-refundable deposits may be required to confirm bookings or projects.
5. Cancellation and Refund Policy
5.1 Cancellation requests must be made in writing to contact@cfxevents.com.
5.2 Refund eligibility will be determined as follows:
Non-Refundable Deposits: Deposits made to secure bookings or services are non-refundable.
Cancellations Within 48 hours: Partial refunds may be available if the cancellation occurs within a specified period before the service start date.
No Refunds: Refunds will not be provided for cancellations made after the service has commenced.
5.3 CFX reserves the right to cancel services at any time, in which case a refund for unused services will be provided.
6. Intellectual Property
6.1 All content created by CFX, including but not limited to designs, videos, graphics, and event materials, remains the property of CFX unless otherwise agreed upon in writing.
6.2 Clients may not reproduce, distribute, or modify CFX’s intellectual property without explicit permission.
7. Limitation of Liability
7.1 CFX will not be held liable for:
Indirect, incidental, or consequential damages.
Delays or failures caused by third parties or unforeseen circumstances.
Losses resulting from the Client’s failure to adhere to these Terms.
7.2 Total liability under these Terms will not exceed the total amount paid by the Client for the specific service in question.
8. Privacy and Data Protection
8.1 CFX collects and processes personal data in accordance with its Privacy Policy, which can be found at www.cfxevents.com/privacy-policy.
8.2 Clients consent to the collection and use of their data for the purpose of fulfilling the Services.
9. Third-Party Services
9.1 CFX may use third-party services to fulfill certain parts of the Services. Clients agree to the terms and conditions of those third-party providers.
9.2 CFX is not responsible for the actions or failures of third-party providers.
10. Indemnification
10.1 Clients agree to indemnify and hold harmless CFX, its affiliates, and employees from any claims, damages, or liabilities arising from the Client’s breach of these Terms or misuse of the Services.
11. Dispute Resolution
11.1 Any disputes arising from these Terms or the Services will be resolved through arbitration before pursuing further legal action.
11.2 Arbitration and disputes will be subject to the laws of Illinois and resolved in the courts of Will County.
12. Amendments
12.1 CFX reserves the right to update these Terms at any time. Changes will be effective immediately upon posting on the website.
12.2 Clients are responsible for reviewing the Terms periodically to stay informed.
